TERMS AND CONDITIONS OF EMBERATOURS TRANSPORTATION COMPANY

Please read these terms and conditions carefully before using our transportation services. By using our transportation services, you acknowledge that you have read, understood, and agreed to these terms and conditions. If you do not agree to these terms and conditions, do not use our transportation services.

Transportation Services: LDS Service & Transport, S.A.  provides transportation services for passengers in Panama. Our transportation services include but are not limited to, airport transfers, private tours, and transportation for recreational activities.

Assumption of Risk: By using our transportation services, you acknowledge and accept the inherent risks and hazards associated with transportation, including but not limited to, accidents, delays, road conditions, weather conditions, and other factors beyond our control. You also acknowledge and accept the risks and hazards associated with any recreational activity for which we provide transportation, as described in the “Release of Liability, Waiver of Claims and Indemnity Agreement” above.

Passenger Conduct: Passengers are required to behave in a responsible and respectful manner while using our transportation services. We reserve the right to refuse service to anyone who engages in disruptive, disrespectful, or illegal behavior. Passengers are responsible for any damage they cause to our vehicles or equipment.

Payment: Payment for our transportation services is not due in full at the time of booking, the user will be paying for a reservation through the accepted credit cards, the rest of the payment will be in cash on the day of the pickup. Cancellations or changes to bookings may result in a fee, as outlined in our cancellation policy.

Cancellation Policy: Cancellations made more than 48 hours before the scheduled pick-up time will receive a full refund. Cancellations made less than 48 hours before the scheduled pick-up time may result in a cancellation fee. No-shows will be charged the full price of the reservation.

Liability: Emberatours is not liable for any loss, damage, injury, or death resulting from the use of our transportation services, except as provided for in the “Release of Liability, Waiver of Claims and Indemnity Agreement” above. We are not responsible for any loss or damage to personal property.

Modification of Terms: We reserve the right to modify these terms and conditions at any time. Any changes to these terms and conditions will be posted on our website and will take effect immediately upon posting.

Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of Panama.

Guna Yala Territory:

Please be advised that Guna Yala is a semi-autonomous indigenous Comarca (territory), and all visitors, including our agency, are subject to the authority of the Guna Congreso (government) while operating within the territory.

As guides and an agency for Guna Yala, we are obligated to adhere to Guna law and work solely with a network of approved Guna contractors for island accommodations and staff, as well as regulated transportation services. Non-Guna staff members are strictly prohibited from working within the islands, and non-Guna owned assets cannot be used for commercial purposes.

Please note that we are required to prepay our contract partners for accommodations and transportation, and therefore cannot guarantee refunds in the event of a service error. We work diligently to ensure that our partners meet the agreed-upon service standards, but we are not responsible for any failures to meet such standards or for any associated compensation.

Despite regulating the options for contractors, the Guna government does not provide any support to our agency in enforcing standards or obtaining compensation from contractors who fail to deliver the agreed-upon service. By engaging our services, you acknowledge and accept these terms and conditions.
